3. What personal data we collect or process

“Personal data” means any information relating to an identified or identifiable natural person. It does not include data collected anonymously or anonymised to the extent that it no longer identifies you and cannot reasonably be linked to you. Depending on how you interact with the Services, where you live and as permitted or required by applicable law, we may collect or process the following categories of personal data, including information inferred from them:

  • Contact details, e.g. name, address, billing address, delivery address, phone number and email address.
  • Financial data, e.g. credit card, debit card and account numbers, payment card details, financial account details, transaction details, payment method, payment confirmations and other payment details.
  • Account data, e.g. username, password, security questions, preferences and settings.
  • Transaction data, e.g. products you view, add to your basket, add to your wish list, buy, return, exchange or cancel, as well as your past transactions.
  • Communications with us, e.g. information you send us as part of a customer service enquiry.
  • Device data, e.g. information about your device, browser or network connection, your IP address and other unique identifiers.
  • Usage data, e.g. information about how and when you interact with and navigate the Services.

4. Sources of personal data

We may collect personal data from the following sources:

  • Directly from you, e.g. when you create an account, visit or use the Services, communicate with us or otherwise provide us with personal data;
  • Automatically through the Services, e.g. from your device when you use our products or services or visit our websites, and through the use of cookies and similar technologies. Where not technically necessary, we only use such technologies with your consent (§ 25 TDDDG, Art. 6(1)(a) GDPR);
  • Through our service providers, e.g. when we engage them to provide certain technologies and they collect or process your personal data on our behalf; and
  • From our Shopify partners or other third parties.

5. Purposes and legal bases of processing

Depending on how you interact with us and which Services you use, we use your personal data for the following purposes:

  • Providing, personalising and improving the Services. We use your personal data to provide the Services to you, in particular to perform our contract with you, process your payments, fulfil your orders, remember your preferences and products you are interested in, send you account-related notifications, process purchases, returns, exchanges and other transactions, create, maintain and manage your account, arrange delivery, facilitate returns and exchanges, enable you to write reviews and create a shopping experience tailored to you, for example through product recommendations based on your purchases. The legal basis is Art. 6(1)(b) GDPR (performance of a contract and pre-contractual measures) and, as regards personalising and improving the Services, Art. 6(1)(f) GDPR (legitimate interest) or your consent under Art. 6(1)(a) GDPR where required.
  • Marketing and advertising. We use your personal data for marketing and advertising purposes, for example to send you marketing, advertising and promotional messages by email, SMS or post and to show you online advertising for products and services on the Services or on other websites, including based on products you have previously bought or added to your basket and your other past activity on the Services. The legal basis is your consent (Art. 6(1)(a) GDPR) or, where permitted by law (e.g. direct marketing to existing customers under § 7(3) UWG), our legitimate interest (Art. 6(1)(f) GDPR).
  • Security and fraud prevention. We use your personal data to verify your account, provide a secure payment and shopping experience, detect, investigate or take action against possible fraudulent, unlawful, unsafe or harmful activity, protect public safety and secure our Services. The legal basis is Art. 6(1)(f) GDPR (legitimate interest). If you use the Services and register an account, you are responsible for keeping your login details safe. We strongly recommend that you do not share your username, password or other login details with anyone else.
  • Communicating with you. We use your personal data to provide customer service, respond to your enquiries, provide you with efficient services and maintain our business relationship with you. The legal basis is Art. 6(1)(b) or (f) GDPR.
  • Legal reasons. We use your personal data to comply with applicable laws or respond to lawful requests, including requests from law enforcement or government authorities, to take part in or investigate civil investigations, potential or actual litigation or other adversarial proceedings, and to investigate potential breaches of our terms or policies. The legal basis is Art. 6(1)(c) GDPR (legal obligation) or Art. 6(1)(f) GDPR.

Our business and marketing partners use the data in accordance with their own privacy notices. You can object to the sharing of data for personalised advertising or withdraw your consent at any time;
  • when you instruct us, ask us or otherwise consent to us disclosing certain data to third parties, e.g. to deliver products to you or when you use social media widgets or login integrations;
  • to affiliated companies or otherwise within our group of companies;
  • in connection with business transactions such as a merger or insolvency, to comply with applicable legal obligations (including responding to subpoenas, search warrants and similar requests), to enforce applicable terms of use or policies, and to protect or defend the Services, our rights and the rights of our users or others.

7. Our relationship with Shopify

The Services are hosted by Shopify. Shopify collects and processes personal data about your use of the Services in order to provide and improve the Services for you. Information you provide in public or semi-public places, including information you share on third-party social media platforms, may also be visible to other users of the Services and/or users of those platforms, without us or the third party being able to restrict its use. The inclusion of such links does not in itself imply endorsement of the content of those platforms or of their owners or operators, unless stated in the Services.

9. Children’s data

The Services are not intended for children, and we do not knowingly collect personal data from children under the age of 16. If you are the parent or guardian of a child who has provided us with personal data, you can contact us using the details below and request that this data be deleted.

10. Data security and retention

Please be aware that no security measure is perfect or impenetrable and we cannot guarantee “absolute security”. In addition, information you send us may not be secure while in transit. We recommend that you do not use insecure channels to send us sensitive or confidential information.

How long we keep your personal data depends on various factors, such as whether we need the data to maintain your account, provide the Services, comply with legal obligations (in particular commercial and tax retention periods), resolve disputes or enforce applicable contracts and policies. After that, the data is deleted or anonymised.
